Terms of Service

Last updated October 26, 2026

Draft. Our attorney has not reviewed these words yet. They may change before ConfirmCue starts charging businesses, and we will tell businesses that use it when they do.

In short

  • ConfirmCue is for businesses. You agree to these terms for your business when you create an account.
  • You keep your data. We use it only to run the service for you.
  • You may text only customers who agreed to get texts from you, and only about their appointments.
  • 30 days free, then monthly. Cancel anytime; you keep the service until the end of the month you paid for.
  • Texts can be late or lost because of phone carriers. Do not use the service for anything urgent.

This summary helps you read the page; the sections below are what counts.

1. This agreement

These terms are an agreement between Broadmill Software LLC (“we”, “us”) and the business that uses ConfirmCue (“you”). The person who creates the account confirms that they may agree to these terms for the business.

These terms include the Acceptable Use Policy, the Data Processing Addendum and the Privacy Policy. If they disagree with these terms, these terms win, except that the Data Processing Addendum wins about your customers’ personal data.

ConfirmCue is for businesses in the United States. It is not for personal, family or household use.

2. The service

ConfirmCue reads the appointments in the calendars you connect, or the ones you add, and sends your customers confirmations and reminders by text and email in your name. It brings their answers back to you. You choose which messages go out, when and with what words.

We may improve and change the service. If a change takes away something important that you use, we tell you at least 30 days before.

3. Your account and your team

  • Give true details and keep them up to date.
  • Keep passwords private. Owners must use two-step sign-in. You are responsible for what happens in your account, including what your team does.
  • Tell us at once at support@confirmcue.com if you think someone else got into your account.
  • Team members must be at least 18 years old and work for or with your business.

4. Texts and emails to your customers

You are the sender of the messages to your customers. They go out in your business’s name, from a number or address we set up for you. You are responsible for them, and you promise that:

  • each customer you text agreed to get texts from your business about their appointments, and you keep a record of that agreement (the app records it for each customer);
  • the phone numbers and email addresses you give us belong to your customers or to people they asked you to contact;
  • your messages are only about appointments: confirmations, reminders, changes and answers. No marketing, sales offers or promotions;
  • you follow the laws on texting and email, including the Telephone Consumer Protection Act and the CAN-SPAM Act, and the phone carriers’ rules;
  • you follow the Acceptable Use Policy.

Some rules protect your customers and cannot be turned off: STOP always stops texts, nothing is texted at night, the same message never goes twice and nothing is sent after an appointment has started. The SMS Terms tell your customers how texts work.

To text from your own toll-free number, the phone carriers need your business’s details (legal name, tax number, address, how customers agree). We send them to our texting provider for you, and you promise they are true. The number is ours, set up for your business; we stop it when your account closes.

5. Your Google Calendar

When you connect a Google Calendar, you let ConfirmCue read the events of the calendars you choose, create events for appointments you add in the app, and add a short mark (like ✅) at the start of an event’s title when a customer answers. We never invite guests and never send Google’s own emails to anyone. You can disconnect at any time in Settings → Calendar or in your Google account. What we do with this access is in the Privacy Policy.

6. Not for emergencies

Phone carriers, email services and calendars are outside our control. A message can be late, filtered or lost, and a calendar change can reach us late. ConfirmCue helps you remind customers; it does not replace your own judgment. Do not use it for emergencies, medical care or anything where a missed message could hurt someone.

7. Your data

Your data is yours: your business details, appointments, customers, messages and answers. You let us store and use it only to run, protect and support the service for you, as the Data Processing Addendum says. We never sell it and never use your customers’ details for our own marketing.

You can export your data at any time (Settings → Your data). An owner can close the account there and open it again within 14 days. When your account closes, we delete your data within 30 days, and from our backups within 35 more days.

We may use counts that name no business or person (for example, how many reminders were confirmed) to improve the service and to describe it.

8. Plans and payment

  • New businesses get 30 days free. After that, the plan you choose is billed every month in advance, in US dollars, through our payment provider. Prices do not include taxes; you pay any that apply.
  • If no plan is chosen when your free days end (or when a plan you canceled ends), we tell you first. Your messages keep going for 7 more days; then we pause sending until you choose a plan. Nothing is charged and nothing is deleted.
  • Each plan has a monthly number of appointments. When you come near it we tell you; we never stop your reminders without telling you first.
  • Founding prices stay the same for 12 months from the first payment. We may change other prices with 30 days’ notice; the new price starts with your next month after that.
  • You can change your plan in the app. A bigger plan starts at once, and you pay the difference for the rest of that month; a smaller plan starts with your next month.
  • You can cancel at any time in the app; closing your account cancels too. You keep the service until the end of the month you paid for. We do not refund part of a month, unless the law requires it.
  • If a payment fails, we tell you and try again. If it still fails after 14 days, we may pause sending until it is paid.

9. When we may pause or close an account

We may pause sending for a business at once if its messages break the law, the phone carriers’ rules or the Acceptable Use Policy, if customers complain about texts they did not agree to, or to protect the service or other businesses. We tell you why and work with you to fix it.

We may close an account for a serious or repeated breach of these terms, or for an unpaid bill. We may also stop offering ConfirmCue; then we tell you at least 60 days before and refund any month paid but not used.

10. Our service and your ideas

ConfirmCue, its software, design and default message wording belong to us. You may use them for your business while your account is open. Do not copy, resell or take apart the service, or try to get around its limits. If you send us ideas or feedback, we may use them freely.

11. No other promises

We work hard to keep ConfirmCue running and correct, but the service is provided “as is” and “as available”. As far as the law allows, we make no other promises, written or implied, including that it will be uninterrupted, free of errors, or fit for a particular purpose.

12. Limits on liability

As far as the law allows, neither side is liable to the other for lost profits, lost revenue, lost data or indirect, special or consequential damages. Each side’s total liability under this agreement is limited to what you paid us in the 12 months before the claim.

These limits do not apply to your duties in the next section, to amounts you owe us, or where the law does not allow them.

13. Claims about your messages

If someone makes a claim against us because of messages sent for your business (for example, a text to a person who did not agree to it), because of the data you gave us, or because you broke these terms or the law, you will defend us and pay the costs, damages and reasonable lawyers’ fees that result. We tell you about the claim quickly and let you control the defense; we may join with our own lawyer at our cost.

14. Ending this agreement

You can end this agreement by closing your account. When it ends, sending stops, your texting number is released and your data is deleted as described above. The sections about your data, payment owed, our service, no other promises, limits on liability, claims and the law continue after the agreement ends.

15. Changes to these terms

We may update these terms. For an important change we email the account owner at least 30 days before it takes effect. If you keep using ConfirmCue after that, the new terms apply; if you disagree, you can cancel before then.

16. The law and the courts

The laws of Virginia and of the United States govern this agreement. Any dispute goes to the state or federal courts in Virginia, and both sides agree to them. Before going to court, each side first tries for 30 days to solve the dispute by writing to the other.

If a part of these terms cannot be enforced, the rest still applies. Not enforcing a part does not mean giving it up. You may not transfer this agreement without our consent; we may transfer it to a company that takes over ConfirmCue. This is the whole agreement between us about the service.
